In further reference to our letter
of yesterday's date, we have to inform you tat
Judgment in this appeal was delivered this morning.
The Appeal has been dismissed and an advance
proof of their Lordships' Reasons for Judgment is
enclosed herewith for your reference and for transmission
to the Colonial Office. Six further prints of the
Judgment and the original and copy King's Order will be
forwarded to you as soon as we have received them
from the Privy Council Office.
lo doubt the sentence will not be carried
into effect until the original Hing's Order has
reached the Colony, but in the meantime and since
we understand that this is the first case of this
particular kind which has been dealt with under the
provisions of the China and Corea Order in Council of
1904 and the Foreign Jurisdiction Act 1890, we wish
to draw your attention to Section 6, Sub-section 1 and
Sub-clause (d) of the Foreign Jurisdiction act and
Section 64 of the Order in Council, which have reference
to certain formalities to be complied with before the
Bentence is carried out.
Copies of the above mentioned sections are enclosed here-
with for your reference.
